Dick--I think they're trying to trick people into thinking they have to pay just bc they are being asked to. Some people may mistake their request for a demand. Kinda like those offers you get in the mail that look like an invoice, then it says in the fine print "this is not an invoice". They hope that some people will just pay it w/o reading the fine print.

Dazes, look through this site. Talk?write, to your Congressman, Senator or State Rep, there are laws about this kind of stuff.

Don't be dramatic, just state the facts and ask them what you need to do, and for them to reply or they will fluff you off.

We went, the UE Referee was a sad sorry little pencil pushing geek! Kind of Barney Fifeish! Boo stated what he has been saying since day one of filing, she rambled incoherently about stuff that had no bearing. She brought some time cards in showing his times, and said he had been sent home before for mistakes. I asked where the cards were that showed these "early dismissals" and she said I don't have them with me. Oops! She showed some paper that signed him up for medical benefits and said why would I fire him if I offered these benefits. We countered with a doc. from UPMC stating benefits began on Oct. 1 and ended Oct. 31. She claimed she paid up until May! Oops! Boo was a nervous wreck but did great, she was a bitch and denied ever using profanity. Who he believed is anyones guess, but Boo was thrilled that he got under her skin as much as he did. One thing that really irks me is we had to pay $18 to PARK! WTF!

Sure does, anyhow, how did you come out of the hearing, win -lose ?
If you lose by a local ruling (more often then not ,you will) but that doesn't mean you can't inquire at the Fed level.

You know Dazes, those Dep't of Labor sites I posted may be worth looking into. For some reason people think it isn't for them to use, but it is.

How many time have you read where someone was re-instated with back pay etc.? That may have happened on a local scale, but you can bet the Feds were nearby, and were the reson the re-instatement happened.

Usually Unions are involved at that level, but anyone is free to try.

Thanks BD but I don't think he wants to work for the nutcase anymore! After reading the post that Cy found, I am not sure I want him working for her anymore. it went as well as I think it could have gone, we'll know in a week or two. He can always appeal to a higher level if he doesn't win this time.

Watch out for calls from "The Easy Yellow Pages" and the "Easy Yellow Pages." Both are .com scams and when they call they mumble the EASY part of the company's name followed by YELLOW PAGES very clearly then state that its time to renew your ad. Both had copies of my Verizon ads, read those to me and asked if I wanted to make any changes. The only thing that gave them away was the fact that they should have known that my billing address differs from the street address that appears in my Verizon ads.

Professor, another time, a telemarketer called my business and got my 16 year old daughter to say my name and answer "yes" to an innocuous question. Then I get a hundred dollar addition to my verizon bill for some web page ad that I knew nothing about....When I finally got through to this company, they replayed a manufactured recording where my daughter's voice says she is me, and agrees to purchase the web page...Verizon was going to turn off my service if I didn't pay...So I lost the hundred bucks, but gained three days of revenge tying up that company's phone lines...
The creeps are still calling, and I enjoy a vindictive pleasure keeping them on the line and making them listen to my (manufactured) life story until they finally hang up
----
Dazes, I'm hoping you win

When I have time, I always keep telemarketers going. I like to ask a lot of questions. Its good practice for future salesman/customer negotiations.

...and sometimes its fun to f*ck with people.
