They are... just not all of them, nor all of them all at once...

But the guy in this story was innocent, so that makes it different

At least he got a judge to decide his fate. In Iraq, he would have been found guilty and execute din the same second, with his body hanging from a bridge to others, that if you can't do the time don't do the crime.
