The Associated Press
ERIE, Pa. -- An Erie County judge has awarded more than $1 million to a man who was run over by a vehicle during a dispute four years ago after the defendant failed to appear at trial.

Judge Michael Dunlavey said Louis Jones, 46, owes the money to 51-year-old David Panetta.

Authorities said Mr. Panetta was talking to a woman at a residence when Mr. Jones confronted him and ran him over, breaking his leg on Aug. 19, 2005. Mr. Jones later pleaded guilty to simple assault, drunken driving and other charges in the incident and served two days of a four-month jail sentence before he was paroled.

Mr. Jones' attorney had argued that Mr. Panetta was hurt as Mr. Jones tried to leave the scene.

dick, sounds like Mr. Jones had his attorney there and being a civil trial, not sure he was required to be there. Of course, he didn't help himself any by not showing.

Had he not had an attorney there and not shown, he would have lost by "default" anyhow.

Looking at what he pled to above, he pretty much sealed his fate then.

I don't if it would've mattered, but the AP writter implies that the defendant's failing to appear defaulted to ruling in favor of the plantiff. I don't know, thats what I got out of it.

dick, that happens a lot in civil cases in places like Las Vegas, Florida, and where there are a lot of transients. Not so much where we live, but now and then it does.

When this guy took the plea and spent time in jail, his lawyer should have told him not to do that then, and/or not allowed that plea to be entered into evidence for this civil trial. He ,in effect, admitted his guilt and left the judge with no choice.

probably doesn't matter, doubt the guy has any money anyhow.
